This is an appeal by Stewart B. Law, Jr., (hereinafter "Appellant") from a denial of a motion for reconsideration entered by the Circuit Court of Upshur County. The lower court had granted summary judgment in favor of Allegheny Power Company (hereinafter "APC"), the State of West Virginia Bureau of Commerce, Division of Natural Resources (hereinafter "DNR"), and the State of West Virginia Department of Transportation, Division of Highways (hereinafter "DOH"). The Appellant filed the underlying civil action alleging entitlement to a right of way or easement to his property through a locked access road near Stone Coal Lake in Upshur County. The Appellant contends that the lower court erred in denying his motion for reconsideration of a summary judgment entered in favor of the Appellees where numerous genuine issues of material fact existed and clarification of those facts was desirable to determine proper application of the law. Based upon a review of the record, arguments of counsel, and relevant precedent, this Court concludes that the lower court abused its discretion in denying the Appellants motion for reconsideration.
